Echoes of Injustice




The RG Kar Hospital case, involving the brutal rape and murder of a postgraduate trainee, has revealed profound flaws in India’s criminal justice system. From mishandling forensic evidence to judicial delays, the case highlights systemic weaknesses that consistently undermine justice in sensitive and high-profile crimes.


The victim, exhausted from long hours, sought refuge in the hospital's seminar hall due to a lack of adequate rest areas for staff. The following morning, her semi-nude body was discovered, signaling a heinous crime. The rather delayed arrest of Sanjoy Roy, a civic volunteer with a questionable history, pressure on the family for cremation, as well as multiple other investigative blunders on part of the police cast a doubt on the entire process.The police's initial assertion of suicide was quickly challenged by the victim’s family, pointing to signs of sexual assault.


As the investigation continued, it became clear that the hospital's security measures were grossly inadequate, with unrestricted access to sensitive areas. This institutional negligence, compounded by the involvement of political actors, has further muddied the waters. The central role of political interference has not only slowed down the process but also diverted attention from the core issue of sexual violence. Roy's suspicious history, including allegations of marital abuse, misbehavior, impersonation of police officers and his questionable access to restricted hospital areas, further cemented suspicions. Evidence, including a torn Bluetooth earphone, linked him to the crime and eventually led to his arrest.


Flawed Investigation and Mishandling of Evidence

The police investigation following the crime was riddled with inefficiencies and questionable decisions. The victim’s family was initially told that the woman had died by suicide, a claim they vehemently denied. The scene, according to the family, clearly pointed to sexual assault, and the fact that they were made to wait for hours before being allowed to view the body only fueled suspicions of a cover-up This raised serious questions about the integrity of the local police investigation. The police's handling of the case is highly questionable.


Further compounding this was the mishandling of forensic evidence, a recurring problem in India's criminal justice system. The delayed access to the family to view the body and the police's questionable handling of forensic evidence exposed grave lapses. Unfortunately, such mishandling of evidence is not a rare occurrence in India, indicating a lack of adequate laws that govern handling of evidence in such delicate matters. Forensic delays often weaken the prosecution’s case, allowing criminals to exploit loopholes.


Delayed Justice and Bureaucratic Inefficiencies

One of the most striking aspects of the legal proceedings in this case has been the sluggish pace of justice. The Indian legal system is characterised by procedural delays. It has failed to respond swiftly to this grave crime, raising concerns about the country’s commitment to addressing sexual violence. Despite the seriousness of the charges, the police took significant time to thoroughly investigate the crime scene and gather forensic evidence. The hospital’s poor security measures, particularly its failure to monitor access to sensitive areas, further complicated the investigation.


Judicial Oversight and Supreme Court Involvement

The involvement of the Supreme Court in the RG Kar case signifies the broader implications of this crime for India’s legal system. The case, now under the scrutiny of a three-judge bench led by Chief Justice DY Chandrachud, has reached the highest echelons of India’s judiciary, underscoring the gravity of the matter.


However, the Supreme Court’s involvement also points to the inherent weaknesses in the lower courts and local police. In the RG Kar case, local police were accused of failing to investigate the crime scene thoroughly and of attempting to classify the death as a suicide. Such failures reveal the limitations of local law enforcement in handling sensitive cases, necessitating the involvement of higher courts.


Despite the heightened attention, the Indian justice system remains plagued by delays, underfunded forensic infrastructure, and a lack of accountability—an all-too-familiar pattern seen in previous high-profile cases.


The Role of the Central Bureau of Investigation (CBI)

The Central Bureau of Investigation (CBI) took over the investigation of the RG Kar case after public outcry and political pressure mounted. While the CBI’s involvement offers hope for a more thorough and impartial investigation, the agency itself is not without controversy. The CBI has often been criticized for being slow in its investigations, and in some cases, it has been accused of succumbing to political pressure. This has led to a perception that justice is often delayed or diluted when the CBI is involved in high-profile cases.


In this particular case, the CBI arrested several individuals linked to the hospital, including former principal Dr. Sandip Ghosh, who is under investigation for financial irregularities that may be tied to the broader circumstances of the case. Ghosh’s arrest and subsequent judicial custody have added another layer of complexity to the case, with questions arising about whether the focus on financial misconduct is diverting attention from the central issue of sexual violence, as well as the alleged involvement of powerful figures.


The Problem of Political Interference

One of the most troubling aspects of the RG Kar case has been the overt political interference that has marred the investigation. West Bengal Chief Minister Mamata Banerjee initially deflected blame by accusing opposition parties of stoking unrest, while opposition figures accused the TMC government of shielding powerful individuals within the hospital administration. This kind of political interference is not uncommon in India, particularly in high-profile cases involving influential institutions. This, however, neither speeds up the procedures, nor does it dispense justice to the victim.

Political meddling in criminal investigations can severely undermine the legal process. It often leads to biased investigations, delayed justice, and compromised evidence.






It's been over a month since the heinous crime took place. Doctors all over the country have walked out on the roads in protest of the slow-paced and flawed investigation of this case.

The incident has brought attention to the violence and harassment that doctors are exposed to in the overburdened healthcare system in the country. Medical professionals are demanding the implementation of the Central Protection Act for Doctors.


This law will ensure ample security and safety for healthcare workers at hospitals.

The “'Prevention of Violence Against Healthcare Professionals and Clinical Establishments Bill, 2022' was first  introduced in the Lok Sabha in 2022. The bill defined the acts of violence, prohibiting violence, establishing cognizability and punishment, mandatory reporting of such acts, public sensitisation, and a grievance redressal mechanism. The offenses under this act are non-bailable, which means that the accused can be arrested without a warrant and are subjected to trial under a  Judicial Magistrate of the First Class.


India’s legal system is often criticized for its inefficiency, but the RG Kar case highlights the deeper structural flaws that prevent timely justice. To prevent similar cases in the future, India must undertake a series of reforms aimed at improving the speed and efficacy of its criminal justice system. The following areas need urgent attention:

  • Safety Protocols in Public Institutions: A Legal Vacuum

    Indian labor and safety laws are notoriously inadequate when it comes to ensuring the safety of workers and professionals in public institutions, including hospitals. There has been minimal legislative progress toward creating safer work environments. This loophole has resulted in continued apathy from medical institutions that fail to implement robust internal security protocols.

    The lack of legal frameworks specifically designed for medical professionals and healthcare workers allows for institutional negligence to go unchecked. Moreover, the enforcement of existing regulations is lax, allowing for unauthorized access, as was evident in this case. There is an urgent need for sector-specific laws that can enforce accountability on hospital administrations, much like laws that exist for industrial safety.

  • Judicial Delays and the Slow Grind of Justice

    One of the most glaring weaknesses of India’s legal system is the delay in the dispensation of justice. Even in cases of grave crimes such as rape and murder, the judicial process is often sluggish. Despite the Supreme Court’s involvement in this case, which indicates the severity and sensitivity of the matter, justice may take years to be delivered.

  • Judicial delays 

    The National Judicial Data Grid (NJDG) shows that millions of cases are pending in Indian courts, and rape cases, despite special provisions under Section 309 of the Code of Criminal Procedure (CrPC), often face inordinate delays. Section 309 requires courts to try rape cases expeditiously, ideally within two months, but this is rarely observed in practice due to several systemic challenges, including the overburdened judiciary and procedural inefficiencies.

    In the case of the RG Kar hospital rape, the delays started early, with the forensic investigation being mishandled and reports suggesting possible evidence tampering.

  • Forensic Failures and the Chain of Custody

    In many criminal cases in India, particularly those involving sexual assault, the importance of forensic evidence cannot be overstated. In the RG Kar case, forensic delays and potential evidence tampering have already tainted the investigation. Indian forensic labs are notoriously slow, with reports taking months, if not years, to be produced.

    The Nirbhaya case of 2012 serves as an important reminder of how crucial timely forensic evidence is to the judicial process. In the current case, forensic evidence, such as the torn Bluetooth earphone linking Sanjoy Roy to the crime scene, has played a pivotal role in his arrest. However, delays in forensic testing could severely impact the strength of the prosecution's case.

    Moreover, the chain of custody has often been neglected in high-profile cases. If the chain of custody is broken or mishandled, it provides an easy route for defense attorneys to cast doubt on the authenticity and integrity of the evidence presented in court. This loophole was evident in case, where concerns of institutional negligence and evidence tampering were raised.





The RG Kar case has exposed the systemic failures of medical institutions to ensure the safety of their employees. Hospitals like RG Kar, which are supposed to be sanctuaries of healing, have become unsafe due to lax security protocols and poor management. The fact that Sanjoy Roy, a civic volunteer, had unrestricted access to various parts of the hospital highlights the severe lapses in security.


Institutional accountability is critical in cases like these, where negligence plays a direct role in enabling such heinous crimes. Unfortunately, Indian institutions, both public and private, have historically been resistant to accountability. In the aftermath of the RG Kar case, several hospital officials, including the former principal, have been implicated in corruption and misconduct, yet there remains little focus on the larger issue of institutional reform.
